I was recently served a summons from my ex for a Motion to Modify Savannah’s custody and child support. I don’t normally speak publicly of my personal hardships or business; however, as some of you know, I currently have joint custody of my daughter Savannah with her father. It was decided by the Court that Savannah should have primary residency here with me in my home state of MS, with her father paying me child support and my having to pay entirely for the expense of her visitation times with him.

Her father has now motioned the Court to take her from me, and strip me of my parental rights having filed for sole custody of Savannah, demanding that I pay him child support as well as all of his attorney and court costs. He’s listed numerous erroneous and unsubstantiated allegations against me. He has relentlessly harassed us and besides the taunting texts, stalking us via a Private Investigator he hired, he also earlier this year filed false allegations of neglect against me with MS Child Protective Services. Upon a preliminary investigation which the social worker apologetically explained to me that they had to do as follow up to every “report”, she said to me that they “found no cause for concern”, and thus a case was never even opened. Everyone in our household was interviewed and a couple home visits were made to clear us, with the CPS worker telling me personally that Savannah’s father was even notified of this since he continued to call their office. Yet he’s now citing that I’ve been “under investigation by MS CPS” as one of his claims as to why I’m an unstable, unfit mother.

I’m simply heart broken for Savannah’s sake, that he’s dragging her/us through this again for *round two*. Savannah doesn’t want to live with her father, and says often that she wishes he’d just leave us alone and care about what she wants. “He doesn’t even ask me what I want.” Savannah’s father is remarried with three young children and a baby on the way. Savannah has said to me that she wishes she didn’t have to visit there even as often as she does, and “wants to stay home”, with her sister and I.

I’m reaching out now to ask for financial help because I simply don’t know what else to do at this point. I am going to have lots more legal issues and bills than I can handle. I’m currently consulting with my attorney whose retainer fee I’m about to pay for with a credit line with ungodly interest rates. My attorney explained that these modification of custody suits often get messier and drag out longer than the original custody battle. And I’m going to have to take time off from work to travel up to MO with the girls for court.

I’m working full time at Savannah’s school while also a student (finishing my Bachelors of Science in Education degree). I have used all my resources to manage this far and am humbled to be asking for your prayers and any financial help. That I might keep my youngest daughter living here with her sister and I, where she belongs and as she so desires. Thank you for your time.

Latest Update

Thank you all so very much for your thoughtful generosity and encouraging words! Thanks to your giving, we were able to pay my attorney her retainer fee of $4000 last Monday, January 22nd. She explained to me that it’s quite likely her fees will supersede that amount, as apparently these types of Modification cases can “be quite messy and drag out even longer than the original divorce/Custody proceedings.” She also explained that I will have to pay another retainer fee to secure a Guardian ad Litem to represent Savannah in this case, according to MO State Custody proceedings. So, my heart is so relieved to have been able to secure legal representation just in time, as my “Answer” to the Motion for Modification Summons is due by 2/2/2018.
