The Piccone Law Firm, LLC is representing Vicki Martin, a Loveland resident whose dog Marlo has been sentenced to death for getting into a fight with a neighbor dog. DA William Stark convinced Ms. Martin to plead guilty to class 2 petty offences, then asked the court to destroy her dog. This is not allowed by ordinance and was NEVER raised as a possible sentence. My firm has filed an appeal to reverse this illegal sentence. The Martin family needs help paying for the appeal. Our opening brief is due by February 16, 2017.

July 27, 2017 UPDATE: We won the appeal!!! Marlo will live! There are about $1200 in costs that still need to be paid, but it's worth it!!!

MARLO WILL LIVE!!!!! The district court agreed with our argument that the death sentence was illegal. Please help his family cover the remaining legal costs for saving his life!!!

I wanted to give you an update on this case. I filed the opening brief to reverse Marlo's illegal death sentence on February 15. The prosecution had 21 days to file an Answer brief explaining why they felt the judge had not made a mistake in sentencing Marlo to death. They DID NOT FILE A BRIEF. Last week the judge assigned to the appeal recused himself (not sure why) and a new judge was randomly assigned the case to Susan Blanco. She was just appointed in the fall. I think her background may be a big plus for us because she should understand criminal procedure and how it was not followed correctly (here's hoping). Her bio: Blanco, the sole practitioner at Blanco Law Office, specializes in criminal law, juvenile delinquency and cases involving dependency and neglect. She has served as Timnath's town prosecutor and this year began working as an adjunct instructor at Colorado State University. Blanco has also worked as a criminal defense attorney and a criminal prosecutor.

The appellate brief is almost finished and ready to be filed. It outlines how the prosecutor and the judge disregarded the plea agreement that they had entered into and added a completely new element to the sentence that was never agreed to or discussed: killing Marlo. We have a very good legal argument as to why the death sentence can't stand. Please help this family fight this injustice. They are making payments, but they are not wealthy. I am writing off as much time as I can, but I need to be paid too. Thank you so much for your support!!
